Age Requirement: The Website is offered only to users who are 18 years of age or older (or the legal age of majority in their jurisdiction). By using the Website, you warrant that you have the legal capacity to enter into a binding contract.

Account Obligations: If you create an account, you must provide accurate information. You are entirely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use or security breach.

The sharing of certain military technical data is strictly regulated by the United States government. As a user, you are solely responsible for ensuring and maintaining your own compliance with all U.S. export control laws.

• Prohibited Content (ITAR/EAR/CUI): You are strictly prohibited from uploading, transmitting, or sharing any Classified Information, Controlled Unclassified Information (CUI), technical data controlled under the International Traffic in Arms Regulations (ITAR), or technology restricted under the Export Administration Regulations (EAR).
• Economic Sanctions (OFAC): You explicitly represent and warrant that you are not located in a comprehensively sanctioned country (e.g., Iran, North Korea) and are not listed on any U.S. government list of prohibited or restricted parties, including the OFAC Specially Designated Nationals (SDN) list or the BIS Denied Persons List (DPL).
• Declassified Misconceptions: Age or public availability does not automatically exempt military data from export controls. Sharing restricted military-technical data with foreign nationals is a federal crime, even if the underlying technology is deemed obsolete or "declassified."
• No Legal Advice: The US Military Archive does not provide legal advice or official government rulings. The fact that a document remains on the site does not constitute a formal Commodity Jurisdiction Determination (CJD) under 22 C.F.R. Part 120, a classification ruling under 15 C.F.R. Part 748, or a guarantee of compliance with ITAR/EAR.

To maintain the integrity of the archive, you agree not to engage in the following prohibited behaviors:

• Uploading content that promotes self-harm, hate speech, doxxing, or harassment.
• Distributing malware, viruses, or utilizing automated scripts (scraping/botting) to access or harvest data from the archive.
• Impersonating active military personnel, veterans, government officials, or other users.
• Uploading intentionally inaccurate historical information or fabricated documents with malicious intent.

Account Termination: We maintain the unilateral right to suspend, terminate, or delete any account or piece of content at any time, for any reason, without notice or liability.

Platform IP: All intellectual property displayed on the Website—including logos, graphics, text, software, and underlying database structures and code—is owned by or licensed to the US Military Archive. You are strictly prohibited from reverse engineering, decompiling, or attempting to extract the source code or trade secrets of the Website.

User Content Licensing: By submitting User Content to the Website, you grant us a perpetual, irrevocable, non-exclusive, royalty-free, fully paid, worldwide license (with the right to sublicense) to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and display such content in any media formats and channels.

To ensure historical integrity and regulatory compliance, the US Military Archive reserves the right to retain server logs, compliance records, metadata (including cryptographic timestamps), and uploaded content for a designated period (often 3 to 6 years), even if a user account is terminated or deleted. We may also place administrative "legal holds" on accounts or documents to preserve evidence relevant to active federal investigations or civil litigation.

We respect the intellectual property rights of others. In accordance with the DMCA, we will respond expeditiously to valid notices of copyright infringement.

Filing a Complaint:

If you believe your copyrighted work has been infringed, submit a written notification to our Designated Copyright Agent at info@usmilitaryarchive.com containing:

1. A physical or electronic signature of the copyright owner or authorized representative.
2. Identification of the copyrighted work claimed to have been infringed.
3. Identification of the specific material that is claimed to be infringing and its specific URL on our Website.
4. Your contact information (name, address, telephone number, and email).
5. A statement that you have a good faith belief that the use is not authorized.
6. A statement made under penalty of perjury that the information is accurate and you are authorized to act on behalf of the owner.

Repeat Infringers: It is our policy to terminate, in appropriate circumstances, the accounts of users who are deemed repeat infringers.

General Disclaimer: The Website and all content are provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the accuracy, completeness, or reliability of historical data, documents, or User Content.

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE US MILITARY ARCHIVE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE WEBSITE; OR (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY. IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).

Force Majeure: The US Military Archive will not be held liable for any delay or failure to perform resulting from causes outside its reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

You agree to indemnify, defend, and hold harmless the US Military Archive, its operators, affiliates, and employees from and against any losses, liabilities, claims, demands, damages, fines, and expenses (including reasonable attorney's fees) arising out of: (a) your use of the Website; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any laws (including fines levied by the Directorate of Defense Trade Controls or the Department of Commerce due to export control breaches) or the rights of a third party.

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

• Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Website shall be resolved by binding, individual arbitration, rather than in court. Both parties agree that any localized, qualifying disputes may be taken to small claims court.
• Class Action Waiver: You and the US Military Archive agree that any proceedings to resolve disputes will be conducted only on an individual basis and not in a class, consolidated, or representative action. You expressly waive your right to a trial by jury.
• Time Limitation: Any claim or cause of action arising out of your use of the Website must be commenced within one (1) year after the claim or cause of action arises, otherwise it is permanently barred.
• 30-Day Opt-Out: You have the right to opt-out of this arbitration agreement by sending written notice of your decision to opt-out to info@usmilitaryarchive.com within 30 days of first accepting these Terms.

• Governing Law & Jurisdiction: These Terms and any disputes arising under them shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal suits must be brought exclusively in the state or federal courts located in Florida.
• Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will otherwise remain in full force and effect.
• Entire Agreement: These Terms constitute the entire agreement between you and the US Military Archive regarding your use of the Website, superseding any prior agreements or communications.
• Updates to Terms: We reserve the right to modify these Terms at any time. Material changes will be communicated via email or site notice. Continued use of the Website constitutes acceptance of the modified Terms.
